Berney’s litigation practice includes commercial and business disputes, First Amendment, defamation and media defense, product liability, and personal injury. He has successfully represented clients in Federal and State Court trials. He has won numerous trials for major national and local manufacturing companies in defending product liability claims. He represents banks and has won trials defending against lender liability claims. He has successfully defended Maine law firms in legal malpractice claims. Berney has also developed a niche practice representing injured skiers in ski area liability litigation. His clients include national and statewide businesses, insurance companies, individuals and self-insured entities in both the United States and Canada. His litigation clients include individuals pursuing personal injury claims, insurance agencies and insurance carriers, real estate agencies, newspapers and television stations. Berney also has a significant personal injury practice on behalf of accident victims.

Berney frequently lectures to legal, business and media groups on a variety of aspects of civil litigation, defamation and how to avoid legal malpractice claims.. Berney has chaired the Maine Bar Association’s Commission on Alternative Dispute Resolution and regularly sieves as a mediator and arbitrator. . In recognition of his legal skills and professionalism, Berney has received an AV® Preeminent Peer Review Rating in the distinguished legal directory, Martindale-Hubbell®.
