Filing fees restored to original levels. - 02.27.03

As with gas prices, what goes down usually comes back up. Effective February 27, 2003, filing fees for various immigration benefits will return to their original levels. As a result of the Homeland Security Act, filing fees had been lowered effective January 24, 2003 to reflect removal of a surcharge. Congress has since restored that surcharge.

The pending transition of INS to the Department of Homeland Security on March 1, 2003 will not affect the restoration of the surcharge, and INS (soon to be Bureau of Citizenship and Immigration Services) will accept applications and petitions postmarked on or before February 27 with the reduced fee that went in effect on January 24 For the time being, checks may be made payable to either the Immigration and Naturalization Service or the Bureau of Citizenship and Immigration Services. Although the filing fees will return to their original levels, the $1,000 "training fee" associated with most H-1B petitions was never changed. It remains $1,000.
