NLRB postpones poster deadline

The NLRB has postponed the deadline for covered employers to post the new employee rights notice until January 31, 2012. See NLRB Bulletin. The requirement was to go into effect in November, and the delay is apparently due to some confusion from employers as to whether they are covered by the National Labor Relations Act. Whether employers are covered by the NLRA generally depends on the volume of business they do, not the number of employees they have. Most private employers are covered.

The NLRB poster is something new that employers will be required to post at their workplaces, advising employees of their rights under the NLRA. While most workplace posters deal with individual employment rights, the NLRB poster advises employees of their rights to organize and bargain collectively, etc. The NLRB’s FAQ on this poster may be found here and a copy of the actual poster here.
