Metcalf and Dumais Claim Victory in Ocean Front Boundary Dispute

In 2004, Clients purchased land in Owl’s Head with the understanding that their parcel extended to the shore of Hendrickson Beach. As the neighborhood changed hands though purchases and sales of property, they were dismayed to find that a waterfront portion of that land, was up for sale by new owners just four years later. The Clients contacted seasoned Eaton Peabody litigator, Judy Metcalf, who joined forces with fellow colleague, Ryan Dumais.
“As soon as Ryan and I looked at the facts of the case,” stated Metcalf, “we understood we had to move aggressively towards the right conclusion for our clients.”
Following a two day trial in Knox County Superior Court, Metcalf, lead attorney, and Ryan Dumais, second chair, successfully demonstrated that the clients’ title to the land was confirmed by adverse possession and occupation of the land by the clients’ predecessors in title for more than twenty years.

The clients’ easement access over the private way to the waterfront parcel was also confirmed by the Superior Court. The Court further rejected the new owners’ arguments about trespass and damages.
