E-Verify Rule for Certain Federal Contractors Further Delayed

April 17, 2009

Implementation of the rule requiring that certain federal contractors participate in E-Verify has been further postponed until at least June 30, 2009.  The rule was formerly delayed until May 19, 2009.  This provides a bit more breathing room for employers facing this requirement, which is currently the subject of litigation in the federal courts.

As noted in our earlier bulletin on this topic, E-Verify is a system for verifying employment eligibility which is in addition to the required I-9 process.  E-Verify is currently voluntary for Maine employers, although the rule seeks to require that government agencies include a clause in certain federal contracts which would require subject contractors to participate.
